Terms and Conditions – JM Media Marketing

These Terms and Conditions (“Terms”) govern the use of services provided by JM Media Marketing (“Company,” “we,” “our,” or “us”) to clients in Canada and the United States. By engaging with our services, you agree to the following Terms.


1. Scope of Services

We provide marketing services including, but not limited to:

Paid media management (Facebook, Instagram, Google, LinkedIn, and other platforms).

Website design, landing page creation, and funnel development.

Lead generation and appointment-setting services.

Marketing consultation and campaign strategy.

The scope of services will be defined in the client agreement or proposal.


2. Client Obligations

Clients agree to:

Provide accurate and up-to-date business information.

Grant necessary access to advertising platforms, websites, or other accounts required for service delivery.

Make timely payments as agreed in contracts or invoices.

Ensure compliance with all applicable laws, including advertising and industry-specific regulations.


3. Payment Terms

Payment terms are outlined in individual contracts or invoices.

Payments are due on the specified dates and may be subject to late fees if unpaid.

Unless otherwise specified in writing, payments are non-refundable, except where a performance guarantee has been explicitly provided.


4. Intellectual Property

Campaign strategies, marketing materials, and systems created by JM Media Marketing remain our intellectual property unless transferred by written agreement.

Clients retain ownership of their brand assets, trademarks, and customer data.


5. Confidentiality

Both parties agree to maintain confidentiality regarding sensitive business information, trade secrets, and client data, except when disclosure is legally required.


6. Limitation of Liability

JM Media Marketing will not be held liable for indirect, incidental, or consequential damages arising from the use of services.

While we commit to applying industry best practices, we do not guarantee specific financial results.


7. Compliance and Acceptable Use

Clients are responsible for ensuring that their products, services, and advertising comply with applicable laws in Canada and the United States. We reserve the right to refuse or suspend services if campaigns violate legal, ethical, or platform-specific policies.


8. Termination of Services

Either party may terminate the agreement with written notice, subject to the terms of the service contract.

All outstanding fees remain payable upon termination.


9. Governing Law

These Terms are governed by the laws of:

Canada, for clients located in Canada.

The United States, for clients located in the United States.


10. Dispute Resolution

In the event of a dispute, both parties agree to attempt good faith resolution. If unresolved, disputes may be referred to binding arbitration within the jurisdiction of the client.


11. Amendments

We may revise these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
